1. Introduction
Cold Beverages (PVT) LTD, hereinafter referred to as “Cold Beverages,” is an e-commerce company serving customers across Sri Lanka.
This User Agreement governs the use and access of the www.coldbeveragesl.com site, its subdomains, and mobile app.
By accessing Cold Beverages services, you agree to be bound by this User Agreement. Cold Beverages reserves the right to amend, modify, omit,
and add to this User Agreement without prior notification, and it is deemed updated once published online.
2. Definitions
User: Any party that accesses, browses, or purchases from Cold Beverages (may be referred to as “you”).
Customer: The party that makes a payment for an order.
Recipient: The party that receives the item ordered by a customer, in the event that the customer is not ordering for him/herself.
3. User Account
3.1. Privileges of the User Account: Users can register for a Cold Beverages User Account to access certain services and earn loyalty points. Registration is based on email, and Cold Beverages cannot reassign points or order history from other accounts.
3.2. Confidentiality of the User Account: Your username, password, and any other sensitive information must be kept confidential. You are responsible for any unauthorized use of your account, and Cold Beverages is not liable for actions taken via your account without verification.
4. Permissible Access
You must be legally permitted to access an e-commerce site and enter into contractual agreements. By accessing the site,
you confirm that you are 18 years or older and shopping for personal purposes only.
5. Use of the Site
Cold Beverages’ site, subdomains, and app must not be used for fraudulent purposes, spreading viruses, testing cards, or money laundering.
6. Purchases
Purchases should be for yourself or a known party. If acting as an agent for another, there must be a clear connection or contractual obligation.
7. Payments for Purchases
7.1. Methods of Payment: Multiple payment methods are available. You must use your own card or payment mechanism.
7.2. Receipt of Payment: Orders requiring prepayment will not be processed until full payment is received. Cold Beverages is not responsible for delays caused by payment issues.
7.3. Payment Disputes: In case of payment disputes, Cold Beverages reserves the right to take recourse, including recovering amounts from the recipient of the order.
8. Out of Stock Items
If a product is unavailable, Cold Beverages may substitute with a similar product or notify you to discuss alternatives.
9. Returns and Refunds
9.1. Defective/Damaged Items: Report defective items within 3 days of receipt via Cold Beverages support. Items found tampered or misused are not eligible for compensation.
9.2. Returning Items: Returns for reasons other than defect/damage may be refused. Complaints should be directed to Cold Beverages support.
10. Intellectual Property
All content on our website, including text, images, logos, and graphics, is protected by intellectual property rights and belongs to Cold Beverages or its licensors.
You may not use, reproduce, distribute, or modify content without prior written consent.
11. Force Majeure
Events beyond reasonable control that materially interfere with obligations (“Force Majeure Events”) will suspend performance but do not excuse it entirely.
12. Governing Law
This Agreement is governed by the laws of Sri Lanka. Disputes shall first be discussed in good faith between parties, and unresolved disputes may be taken to a competent Sri Lankan court.
